Welcome to our Haulage Division. All services provided by Prigmore Haulage Ltd are governed by the terms set out below. By booking a consignment with us, you agree to these terms in full.

1. Core Conditions of Carriage
All transport business is undertaken strictly in accordance with the Road Haulage Association (RHA) Conditions of Carriage 2024.

Liability: Our liability for loss, mis-delivery, or damage is limited to the RHA standard of £1,300 per tonne on the gross weight of the goods.

Insurance: Customers are responsible for arranging "All Risks" insurance if the value of the consignment exceeds this limit.

Claims: Any damage or shortage must be notified in writing within 7 days of delivery.

2. Hazardous Goods (ADR & Limited Quantities)
As a specialist hazardous goods carrier, we adhere to strict safety protocols:

Consignor Responsibility: The customer must correctly classify, pack, and label all goods. For full ADR loads, a completed Dangerous Goods Note (DGN) must be provided prior to transit.

Limited Quantities (LQ): For LQ loads, the customer must declare the total gross mass of the goods to ensure vehicle threshold compliance.

Safety Rights: Our drivers reserve the right to refuse any load that is leaking, damaged, or improperly secured.

3. Payment & Credit Terms

Standard Terms: Unless otherwise agreed in writing, payment is due 30 days from the end of the month of the invoice date.

Training Division: Training fees must be settled in full prior to the course start date to guarantee certification.

4. Waiting Time (Demurrage)
To maintain an efficient schedule, we provide the following complimentary loading/unloading periods:

HGV: 2 hours inclusive.

Vans: 1 hour inclusive.

Additional Charges: Any detention beyond these times (not caused by the carrier) will be billed at our standard hourly rate in 30-minute increments.

5. Two-Way Fuel Mechanism
Our rates adjust transparently based on our primary fuel supplier’s weekly price (net of VAT):

Neutral Zone (0%): 108.0p to 112.0p per litre.

Surcharge: +1% for every 4p increase above 112.0p.

Rebate: -1% for every 4p decrease below 108.0p.

6. Cancellations & Site Access

Cancellation Fees:
-
24h+ notice: Free.
-
12–24h notice: 50% of fee.
-
<12h notice: 100% of fee.

Driver Welfare: In line with HSE and RHA standards, customers must provide our drivers with access to on-site welfare facilities (toilets and rest areas)

8. General Legal Provisions

Right of Lien: The Carrier shall have a general lien on all Goods in its possession for all monies due from the Customer on any account. If such a lien is not satisfied within 14 days, the Carrier shall be entitled to sell the Goods and apply the proceeds towards any monies due and the expenses of the sale.

Loading and Unloading: Unless otherwise agreed in writing, the Customer is responsible for the loading and unloading of the vehicle. The Carrier shall not be liable for any loss or damage caused by the instructions or supervision of the Customer’s personnel during these processes.

Force Majeure: The Carrier shall not be liable for any delay or failure to perform its obligations if such failure results from events beyond its reasonable control, including but not limited to: extreme weather, road closures, fuel shortages, industrial action, or acts of God.

Proof of Delivery (POD): The Customer agrees that an electronic signature, a photograph of the goods at the delivery location, or a GPS-verified arrival confirmation shall constitute sufficient Proof of Delivery. Payment may not be withheld due to the absence of a physical paper signature.

Governing Law: These terms shall be governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the English courts.
